Trademark renewal in Ukraine

The validity period of a trademark certificate in Ukraine is 10 years. Trademark registration can be renewed in Ukraine.

There are no limits on how many times a trademark can be renewed.

The expiration date is calculated from the application date.

The renewal procedure becomes available 6 months before the trademark’s expiration date.

Grace period

Ukraine provides a trademark renewal grace period as well. There are additionally 6 months in a grace period, but the official fee is increased by 50% if a trademark owner wants to make a trademark renewal fee after the deadline is missed.

In case both the expiration date deadline and the deadline within a grace period are missed, a trademark is considered expired. Restoring a trademark after it is not possible.

Within the next 24 months after the expiration date, the application for the same trademark could be filed by the same applicant only.

The trademarks in Ukraine have expiration dates, which are 10 years from the trademark application date.

The trademark renewal procedure should be repeated every 10 years to keep the legal rights of a brand name.

The legislation provides a 6-month period before the expiration date to request a renewal.

Trademark owner could calculate this term independently or use Pocket IP service, which sends notifications on deadlines automatically.

The Ukrainian IP Office does not notify trademark owners or their representatives on the trademark expiration date approaches.

Ukraine provides an additional 6-month grace period in case of a deadline to renew a trademark timely was missed.

If the final deadline was missed as well, during the next two years only a previous owner has a right to file an application for the same trademark.

Non-residences of Ukraine need licensed patent attorneys for most actions with their Intellectual property rights objects – trademark renewing is one of them.

If the trademark owner has the status of a resident of Ukraine, trademark renewal could be requested without a legal representative.

It is not necessary to provide evidence of the use of a trademark to renew a trademark in Ukraine.

However, if a trademark is not used in Ukraine in full or in relation to a part of the goods and services specified in the certificate continuously within 5 years from the date of publication of information on the issuance of the certificate or if the use of the trademark is suspended from another date after this publication for a continuous period of 5 years, any person has the right to apply to the court for early termination of a trademark certificate in whole or in part.

The updated information on the trademark expiration date is published shortly after the procedure for renewal of the trademark is completed. Pocket IP updates information on a trademark automatically in the user’s personal account immediately.

Ukrainian IP Office upon request could issue a new trademark certificate in electronic and paper form.

Firstly, check the trademark registration details to confirm the expiration date.

Secondly, prepare and sign a power of attorney in the name of a local patent attorney, which is mandatory in Ukraine for non-residents. Most likely, the validity term of the previous POA is already expired.

Thirdly, confirm the trademark renewal procedure and pay official fees.

Shortly after that, the information on the new expiration date will be updated in the official trademark database and in Pocket IP service.
