Despite the obtained trademark registration in the EU (EUIPO), the trademark should be renewed every 10 years. In case of missing the renewal deadline, the legal rights on a trademark are lost.

The 10-year validity term is calculated from the application date. The expiration date is stated in a trademark certificate and in the EUIPO public system as well.

A trademark can be renewed an unlimited number of times based on payment of the fee and submission of the relevant request during the last 6 months of the certificate's validity.

The trademark's expiration date is the last day to submit a request for renewal and pay the associated cost.

The Office provides an additional 6-month period to pay the official fee for renewal if the deadline is missed (so-called grace period). However, the amount of fees increased by 25% in this case.

If a trademark owner misses the final expiration date within an additional grace period as well, there is no option to restore trademark registration only by filing a new application and go through the all registration process again.

An EUTM may be renewed partially – for some of the goods and/or services only. In this case, a trademark owner pays the official fee for the valid classes only and loses the protection for other classes.

It is possible to request also a conversion – convert EUTM registration into national registration in some EU countries.

There is no need to provide evidence of the use of a trademark during the registration procedure or renewal procedure. Still, if a trademark was not in use for 5 consecutive years, other parties have a right to request the cancelation of such a trademark.

Non-EU residents are obliged to have a licensed European trademark attorney to request a trademark renewal. The POA is not required for this action.

If the trademark is not used in the EU in whole or concerning a part of the goods and services specified in the certificate continuously for five years from the date of publication of the information on the issuance of the certificate, or if the use of the trademark is suspended from another date after this publication for an uninterrupted period of five years, any person has the right to file the claim for early termination of such registration in whole or in part.

An additional 6-month grace period is provided in case a deadline to renew a trademark timely was missed.

If the final deadline was missed as well, the only way is to file a new trademark application.

The updated information on the trademark expiration date is published shortly after the procedure for renewal of the trademark is completed.
