In Azerbaijan, every 10 years a trademark should be renewed, otherwise the legal rights on it will be lost.

The 10-year validity term is calculated from the application date.

A trademark can be renewed an unlimited number of times based on payment of the fee and submission of the relevant request during the last 6 months of the certificate's validity.

If the deadline is missed, an additional 6-month period is provided (grace period). In this case, the amount of the fee increases for each month the deadline is missed.

If the rights to a trademark expire, other persons may apply for similar designations without restrictions.

Foreigners must carry out all trademark registration activities through a licensed Azerbaijani trademark attorney.

There is no need to provide evidence of using a trademark during the registration or renewal procedures.

If the trademark is not used in Azerbaijan in whole or concerning a part of the goods and services specified in the certificate continuously for five years from the date of publication of the information on the issuance of the certificate, or if the use of the trademark is suspended from another date after this publication for an uninterrupted period of five years, any person has the right to file the claim to the Agency’s Board of Appeal with an application for early termination of such registration in whole or in part.

How do I know whether the trademark validity term is extended in Azerbaijan?

The updated information on the trademark expiration date is published shortly after the procedure for renewal of the trademark is completed.
