Trademark renewal Azerbaijan

In Azerbaijan, every 10 years a trademark should be renewed, otherwise the legal rights on it will be lost.

The 10-year validity term is calculated from the application date.

A trademark can be renewed an unlimited number of times based on payment of the fee and submission of the relevant request during the last 6 months of the certificate's validity.

If the deadline is missed, an additional 6-month period is provided (grace period). In this case, the amount of the fee increases for each month the deadline is missed.

If the rights to a trademark expire, other persons may apply for similar designations without restrictions.

Foreigners must carry out all trademark registration activities through a licensed Azerbaijani trademark attorney.

There is no need to provide evidence of using a trademark during the registration or renewal procedures.

Trademarks in Azerbaijan have a 10-year expiration date from the date of application.

To protect a brand’s legal rights, the trademark renewal process should be repeated every ten years.

The legislation provides a 6-month period before the expiration date to request a renewal.

Trademark owners could calculate this term independently or use the Pocket IP service, which sends notifications on deadlines automatically.

The IP Office (COPAT) does not notify trademark owners or their representatives on the trademark expiration date approaches.

Non-residents of Azerbaijan require licensed patent attorneys for the majority of acts involving their intellectual property rights, including trademark renewal.

If the trademark owner has the status of a resident of Azerbaijan, trademark renewal could be requested without a legal representative.

An additional 6-month grace period is provided in case a deadline to renew a trademark timely was missed.

If the final deadline was missed as well, the only way is to file a new trademark application.

It is not necessary to provide evidence of the use of a trademark to renew a trademark in Azerbaijan.

If the trademark is not used in Azerbaijan in whole or concerning a part of the goods and services specified in the certificate continuously for five years from the date of publication of the information on the issuance of the certificate, or if the use of the trademark is suspended from another date after this publication for an uninterrupted period of five years, any person has the right to file the claim to the Agency’s Board of Appeal with an application for early termination of such registration in whole or in part.

The updated information on the trademark expiration date is published shortly after the procedure for renewal of the trademark is completed.
