Maintaining a registered trademark requires periodic renewal. Without renewal, a mark loses its legal protection and can be cancelled. Tajikistan’s trademark system has developed rapidly since the adoption of the Law of the Republic of Tajikistan on Trademarks and Service Marks (Trademark Act) in 2007. Today, the legislation is harmonised with international treaties, including the Madrid Agreement and the Madrid Protocol, so brand owners can file international designations through WIPO or file directly in Tajikistan.

A Tajik trademark registration is valid for 10 years from the filing date. Article 16 of the Trademark Act stipulates that the registration may be renewed for further ten‑year periods at the request of the owner. The renewal request must be filed in the final year of the registration (i.e., within 12 months before the expiration date). The right holder may renew the trademark an unlimited number of times, ensuring perpetual protection as long as renewals are kept current.

The Tajik Cabinet of Ministers sets official fees for trademark renewal. In 2025 the National Patent and Information Center (NCPI) announced that the fee for renewing a trademark certificate for the next ten years increased by approximately 4 % – from 3 ,841 somoni (~USD 416) to 3 ,984 somoni (~USD 432). This official fee covers renewal of a domestic registration, regardless of whether the mark contains one or multiple classes (Tajik domestic renewals do not adopt a per‑class fee structure). In the Madrid system, Tajikistan has declared an individual fee for renewal: according to WIPO’s schedule of Madrid Protocol fees, the renewal fee for designating Tajikistan is 274 Swiss francs for the first class plus 21 Swiss francs for each additional class.

Additional costs

Late renewal incurs a surcharge. The law does not fix the amount of the surcharge; it is calculated as a percentage of the official fee and published in the NCPI’s tariff schedule. For international designations, WIPO charges an extra fee if the renewal is filed after the due date.

Importantly, if a trademark expires and is not renewed, it cannot be registered by another person for one year from the expiration date. This cooling‑off period (previously three years under older legislation) prevents opportunistic re‑registration and allows the former owner time to file a new application.

The proprietor may avoid cancellation by proving that non‑use resulted from circumstances beyond their control. Nominal use, such as advertising or publication of the mark, is generally considered sufficient.
