The Law of Ukraine “On the Repeal of the Law of Ukraine ‘On the Protection of the Interests of Individuals in the Sphere of Intellectual Property During Martial Law Introduced in Connection with the Armed Aggression of the Russian Federation Against Ukraine’” has been officially published and will enter into force on May 31, 2025.
Accordingly, the provisions introduced in 2022, which “froze” deadlines for actions related to intellectual property (IP) rights and provided for the automatic extension of the validity of all IP objects, will be repealed.
Starting May 31, 2025, all standard deadlines for actions related to trademarks, patents, and other IP rights will be reinstated, including deadlines for:
– payment of official fees,
– responding to communications from the IP Office,
– filing oppositions, etc.
A 75-day transitional period has been established for IP objects for which procedural deadlines were missed during the martial law period (beginning February 24, 2022).
Thus, annual maintenance fees for patents (including inventions and utility models), industrial designs, and plant varieties, as well as the deadlines that fell during martial law and which were not paid, will be considered timely if paid by August 14, 2025.
August 14, 2025, is also the final date on which the payment of renewal fees for trademark registrations will be deemed timely, if the renewal deadline was missed during the martial law period.
